Terms of Service again

Hi there,

i have the following checkbox for the terms of service:
<input type=checkbox name="agree" value="1">

and added the following to the orders_delivery.tpl:
,Array( 'agree', 'simple', 'Please agree!' )

But it doesn't recognize if the checkbox is checked or not.
Any ideas?

...with the select field it works fine, but i would like to use a checkbox.
Isn't that possible?
